ICAO COUNCIL RECEIVES REPORT ON KAL 007 Montreal, 1 3 December 1983 -- The Council of ICAO has conducted an i n i t i a l examination of the r e p o r t of t h e i n v e s t i g a t i o n by i t s Secretary General of t h e d e s t r u c t i o n o f Korean A i r Lines f l i g h t 007 near Sakhalin I s l a n d , USSR, on 1 September 1983. I n concluding i t s i n i t i a l examination, t h e Council adopted a r e s o l u t i o n exhorting a l l p a r t i e s involved i n t h e i n v e s t i g a t i o n t o cooperate f u l l y i n f u r n i s h i n g t o ICAO without r e s e r v a t i o n , a l l information a t t h e i r d i s p o s a l as soon as p o s s i b l e . The r e s o l u t i o n a l s o r e f e r r e d t h e report t o the Organization's A i r Navigation Commission f o r a t e c h n i c a l review i n l i g h t of i t s ongoing review of a l l r e l a t e d i n t e r n a t i o n a l provisions. The Council w i l l continue i t s consideration of the matter during i t s next s e s s i o n beginning on 23 January 1984. The r e p o r t of t h e i n v e s t i g a t i o n , conducted by a team of t e c h n i c a l e x p e r t s from within t h e Organization's p r o f e s s i o n a l S e c r e t a r i a t under t h e d i r e c t i o n of i t s Secretary General, M r . Yves Lambert, was given t o r e p r e s e n t a t i v e s on t h e 33-member ICAO Council on 5 December. The i n v e s t i g a t i o n w a s c a l l e d by a n Extraordinary Session of t h e Council on 16 September. The r e p o r t i n d i c a t e d t h a t both t h e f l i g h t crew of KAL 007 and t h e a i r c r a f t , a Boeing 747, were properly c e r t i f i c a t e d and t h a t a l l necessary navigation and a v i o n i c s systems were operable on t h e f l i g h t ' s departure from Anchorage, Alaska, United S t a t e s . I t s departure t i m e w a s found t o be c a l c u l a t e d c o r r e c t l y f o r an "on-time" a r r i v a l i n Seoul, Republic o f Korea, had t h e f l i g h t followed i t s planned and assigned r o u t e . Soon a f t e r i t s departure, however, the i n v e s t i g a t i o n found t h a t t h e f l i g h t began s t r a y i n g s l i g h t l y t o t h e r i g h t of i t s assigned course. A t t h e t i m e of i t s d e s t r u c t i o n , it was some 300 n a u t i c a l m i l e s t o t h e north of i t s assigned r o u t e over t h e sovereign t e r r i t o r y of t h e USSR. Further, t h e r e p o r t i n d i c a t e s t h e r e w a s no evidence of The r e p o r t p o s t u l a t e s t h a t i t The ICAO i n v e s t i g a t i o n , which i s t h e b a s i s f o r t h e Council's d e l i b e r a t i o n s concerning t h e d e s t r u c t i o n of KAL 007, included f i e l d v i s i t s t o Japan, Republic of Korea and t h e United S t a t e s . The Secretary General and t h e l e a d e r of t h e i n v e s t i g a t i o n team v i s i t e d t h e USSR from 11 t o 1 7 November 1983. I n a d d i t i o n , members of t h e i n v e s t i g a t i o n t e a m observed search and rescue and salvage e f f o r t s i n t h e Sea of Japan where t h e a i r c r a f t crashed and sank. Team members a l s o t r a v e l l e d t o S e a t t l e (United S t a t e s ) , where f l i g h t simulation s t u d i e s w e r e conducted a t t h e Boeing Company. The submerged wreckage of KAL 007 w a s t h e s u b j e c t of i n t e n s i v e search and rescue and salvage e f f o r t s f o r over two months. t h e wreckage and of personal property w e r e found. recorders - t h e so-called "black boxes" - were not recovered from t h e wreckage. Search and rescue and salvage operations have now been suspended o r terminated by a l l States. Нowever, only fragmentary p i e c e s of The f l i g h t d a t a and cockpit voice Also t o be considered by t h e Council is a r e p o r t of ICAO'S A i r Navigation Commission (ANC) on i n t e r c e p t i o n of a i r c r a f t . Pending review of t h e i n v e s t i g a t i o n d a t a , t h e ANC r e p o r t presents t e n t a t i v e conclusions of t h e Commission, including t h e n a t u r e and scope of p o t e n t i a l measures aimed a t assuring t h e s a f e t y of c i v i l a i r c r a f t i n areas where i n t e r c e p t i o n s could occur. The t e c h n i c a l body has concluded t h a t t h e c u r r e n t ICAO provisions are adequate t o p r o t e c t c i v i l a v i a t i o n i f they are s t r i c t l y applied g l o b a l l y by a l l S t a t e s and f l i g h t o p e r a t o r s . P o t e n t i a l improvements i t has recommended include t h e r o u t i n e exchange of f l i g h t plan' information between adjacent a i r t r a f f i c c o n t r o l a u t h o r i t i e s and maintenance of two-way air-ground radiocommunications e s p e c i a l l y f o r t h e r e p o r t i n g of p o s i t i o n s i n designated s e n s i t i v e areas and a i r r o u t e s i n order t o f a c i l i t a t e i d e n t i f i c a t i o n of c i v i l a i r c r a f t and avoid t h e need f o r i n t e r c e p t i o n s . The ANC a l s o recommended t h a t a l l i n t e r c e p t c o n t r o l u n i t s as w e l l as i n t e r c e p t i n g and intercepted a i r c r a f t be a b l e t o communicate on t h e aeronautical emergency frequency 121.5 MНz. The Council of ICAO previously decided t o convene a n Extraordinary Session of t h e Assembly of 152 Contracting S t a t e s on 24 April 1984, t o consider proposed amendments t o t h e Convention on I n t e r n a t i o n a l C i v i l Aviation o r o t h e r measures t h a t would assure t h a t S t a t e s a b s t a i n from t h e use of f o r c e a g a i n s t c i v i l a i r c r a f t .
